Affiliate Agreement

This Affiliate Agreement ("Agreement") is entered into between Home Fixora ("Network") and the approved affiliate ("Affiliate"). By participating in the Home Fixora program, Affiliate agrees to these terms and to applicable written campaign terms.
1. Affiliate Approval
Participation is subject to Network approval. Network may approve or reject applications in its sole discretion.
2. Campaign Authorization
Approval for one campaign does not authorize traffic for any other campaign. Each campaign requires separate written authorization.
3. Traffic Source Disclosure
Affiliate shall disclose all traffic sources, methods, and creatives used to generate calls or leads and shall not introduce undisclosed sources.
4. Sub-Affiliate Responsibility
Sub-affiliate traffic requires written approval. Affiliate is fully responsible for the acts and omissions of all sub-affiliates operating under Affiliate's account.
5. Tracking
Affiliate shall use the approved tracking setup and shall not tamper with tracking, dispositions, or sub-ID data.
6. Qualified Calls and Leads
An event is billable only when it satisfies the written campaign requirements and passes reconciliation. Duration alone does not make an event billable.
7. Invalid Activity and Fraud
Fraudulent, manufactured, AI-generated, coached, or otherwise invalid activity is prohibited and may result in withholding of payment, suspension, or termination.
8. Payment Terms
Payment cadence and terms are set forth in the applicable campaign terms and may depend on tier, quality history, and reconciliation. Network may adjust or withhold payment for invalid activity.
9. Reconciliation
Network reports are subject to reconciliation. Affiliate acknowledges that final billable counts may differ from real-time reporting.
10. Compliance and Consent
Affiliate shall comply with all applicable laws, including consumer protection, telemarketing, and privacy laws, and shall maintain valid consent records where required.
11. Intellectual Property
Each party retains its intellectual property. Affiliate is granted a limited license to use approved creatives solely for authorized campaigns.
12. Confidentiality
Non-public information exchanged under this Agreement is confidential and may only be used to perform under this Agreement.
13. Indemnification
Affiliate shall indemnify Network against claims arising from Affiliate's traffic, sub-affiliates, creatives, or breach of this Agreement.
14. Suspension and Termination
Network may suspend or terminate Affiliate at any time for violation of these terms, quality standards, or applicable law. Suspended accounts may be ineligible to reapply for at least 30 days.
15. Limitation of Liability
To the fullest extent permitted by law, Network is not liable for indirect, incidental, special, or consequential damages.
16. Recordkeeping
Affiliate shall retain records sufficient to substantiate traffic sources, consent, and compliance for a period consistent with applicable law.
17. Governing Law and Notice
This Agreement is governed by the laws of the State of New Mexico. Notices to Network shall be sent to the address below or as later designated in writing.
